1. Acceptance of Terms

Welcome to ItsTrend.in, operated by ItsTrend ("we", "us", "our"). By accessing or using our website at itstrend.in, placing an order, or creating an account, you confirm that you have read, understood, and agree to these Terms & Conditions and all applicable Indian laws, including the Consumer Protection Act 2019, the Information Technology Act 2000, and the Sale of Goods Act 1930.

If you do not agree to these terms, please do not use our platform.

2. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to place an order or create an account on ItsTrend.in. By using this platform, you represent and warrant that you meet this age requirement.

If you are under 18, you may only use this site under the supervision of a parent or legal guardian who agrees to these terms on your behalf.

3. Your Account

3.1 Registration

When you create an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Account Security

You must notify us immediately at support@itstrend.in if you suspect any unauthorised use of your account. We are not liable for any loss arising from unauthorised use of your account before notification.

3.3 Account Termination

We reserve the right to suspend or permanently terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion, with or without prior notice.

4. Products & Pricing

4.1 Product Descriptions

We make reasonable efforts to display product colours, designs, and specifications accurately. However, we cannot guarantee that your device's display will accurately reflect the final product. Minor variations in colour or finish are normal for print-on-demand merchandise.

4.2 Pricing

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price shown at the time of checkout.

4.3 Availability

Limited-drop products are available while stocks last. We reserve the right to limit quantities per customer and to discontinue products at any time.

5. Orders & Payment

5.1 Order Confirmation

Placing an order constitutes an offer to purchase. An order is confirmed only when you receive a confirmation message from us (via WhatsApp or email). We reserve the right to refuse or cancel any order at our discretion.

5.2 Payment

Payments are processed through Razorpay, a PCI-DSS compliant payment gateway. We accept UPI, credit/debit cards, net banking, digital wallets, and Cash on Delivery (COD) where available. By completing a payment, you authorise us to charge your selected payment method for the total order amount.

5.3 Failed Transactions

If a payment fails after being deducted from your account, the amount will typically be refunded within 5–7 business days by your bank or payment provider. Please refer to our Payment Policy for full details.

6. Print-on-Demand & Custom Orders

6.1 Design Uploads

When you upload artwork or images for custom products, you represent and warrant that you own or have the full right to use that artwork, that it does not infringe any third-party intellectual property rights, and that it complies with our content guidelines (no obscene, hateful, or illegal content).

6.2 Production Time

Custom orders typically require 3–5 business days for production before dispatch. This is separate from shipping time. Please see our Shipping Policy for delivery timelines.

6.3 Content Moderation

We reserve the right to refuse, cancel, or remove any custom order that contains content we deem offensive, illegal, or in violation of third-party rights. In such cases, a full refund will be issued.

7. Intellectual Property

All content on ItsTrend.in — including logos, designs, graphics, text, software, and the overall look and feel of the platform — is the exclusive property of ItsTrend or its licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, modify, create derivative works from, or otherwise exploit any content from our platform without express written permission from us.

7.1 Creator Content

Creators who sell products through ItsTrend retain ownership of their original designs. By listing on our platform, creators grant ItsTrend a non-exclusive, royalty-free licence to display, reproduce, and promote their designs for the purposes of operating the platform.

8. Prohibited Conduct

You agree not to:

• Use our platform for any unlawful purpose or in violation of any applicable law or regulation;
• Infringe the intellectual property rights of ItsTrend or any third party;
• Transmit any harmful, offensive, defamatory, or fraudulent content;
• Attempt to gain unauthorised access to our systems or another user's account;
• Use automated tools (bots, scrapers) to access or extract content from our platform without written consent;
• Engage in any form of price manipulation, fraudulent orders, or chargeback abuse;
• Upload designs that contain hate speech, explicit sexual content, or content that glorifies violence.

9. Limitation of Liability

To the fullest extent permitted by law, ItsTrend shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of (or inability to use) our platform or products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of our platform shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under the Consumer Protection Act 2019 or other applicable Indian law.

10. Indemnification

You agree to indemnify, defend, and hold harmless ItsTrend and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your use of our platform, or any content you upload or submit.

11. Termination

We may terminate or suspend your access to our platform immediately, without prior notice, if you breach these Terms. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) shall remain in effect.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

For consumer disputes, you may also approach the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act 2019.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
